Workers’ Comp Insurance Claimant Fraud
Workers’ Compensation Insurance Claimant Fraud occurs when an employee makes a false claim of an injury; or when an employee does not disclose other precedent injuries to the same body part; or when an employee does not divulge money being earned while receiving payments for the injury, or for any other material misstatement during the claims process. This Lunch and Learn will identify the types of misrepresentations that make for successful prosecution, the red flags associated with claimant fraud, and the penalties that can be imposed after convict.
Michael Chiriatti is with the SBDA Workers’ Compensation Fraud Unit, where he prosecutes a variety of cases involving claimant, premium and provider fraud. He has been a fraud prosecutor for the past 13 years and is the Lead Prosecutor of the Unit. He is also an Advisory Board Member to the Employers’ Fraud Task Force and Board Member for the Southern California Fraud Investigator’s Association.
Michael earned his undergraduate degree in Political Science from Pepperdine University and his Juris Doctor, With Great Distinction, from the University of the Pacific, McGeorge School of Law.
