Employers Beware: Misuse of Employee Information Obtained
From Social Media Sites Can Result in Costly Litigation

The impact of social media on the workplace continues to evolve as employers increasingly face lawsuits related to how they use employee information contained on social media sites such as Facebook, Twitter and Linkedin. This lunchtime presentation will focus on workplace policies and procedures related to social media; a review of the recent case law and legislation related to social media; and, a look at how recent National Labor Relations Board (NLRB) advisory letters on social media may provide guidance for employers. The presentation will also focus on whether an employer can use social media for personnel screening purposes; whether an employer can require that an employee remove a derogatory post; and, whether an employer can require an employee to provide the password to his or her social media site.
